Terms of Service

1. Parties & acceptance
These Terms of Service ("Terms") are a binding agreement between you (or the organization you represent) and Evanik Networks Private Limited ("Evanik", "we", "us"), a company incorporated in India with its registered office at D79, Ground Floor, Sector 2, Noida, Uttar Pradesh — 201301, India. Evanik operates the Zobrx marketing intelligence platform at www.zobrx.com. By accessing or using Zobrx, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization.
2. Service description
Zobrx provides a marketing intelligence platform that ingests data from third-party systems you authorize, applies analytics and AI, and surfaces recommendations. You remain the data controller of your workspace data.
3. Subscription & billing
Subscriptions renew automatically at the end of each billing period unless cancelled. Monthly plans may be cancelled at any time; annual plans may be cancelled for a prorated refund within 30 days of purchase.
4. Acceptable use
You agree not to use Zobrx for unlawful purposes, including (a) processing data without appropriate consent, (b) violating third-party platform terms, (c) reverse engineering our services, or (d) reselling Zobrx without an authorized partner agreement.
5. AI use
You are responsible for reviewing AI-generated recommendations before taking action on them. Zobrx provides advisory output; ultimate decision-making rests with you and your team.
6. Service levels
Uptime targets: 99.5% (Starter), 99.9% (Growth), 99.95% (Scale), 99.99% (Enterprise). See the Enterprise agreement for SLA credits.
7. Liability
Zobrx's aggregate liability under these terms is limited to the fees paid in the 12 months preceding the event giving rise to the claim, except where prohibited by law.
8. Governing law & jurisdiction
These Terms are governed by the laws of India. Exclusive jurisdiction lies with the courts of Gautam Buddha Nagar (Noida), Uttar Pradesh, India. For customers contracting with a Zobrx affiliate in another jurisdiction via a written order form, the order form's choice-of-law and venue clause prevails. Consumer protection laws in your jurisdiction prevail where they provide greater rights than these Terms.
9. AI output & responsibility
Zobrx AI surfaces recommendations. You retain responsibility for actions taken based on those recommendations, including budget changes, creative publication and customer communications. AutoPilot modes, where enabled, apply within guardrails you configure.
