Acceptable Use Policy

1. Purpose
Our platform helps sellers operate their own marketplace businesses. This policy sets out what customers may not do using it. It exists because our access to marketplace data is granted to us on trust, under agreements with those marketplaces — including Amazon — and because misuse by one customer places every other customer's access at risk.
Breach of this policy is a material breach of our Terms of Service.
2. Marketplace agreement compliance
2.1 You must comply at all times with the terms of every marketplace on which you sell, including the Amazon Services Business Solutions Agreement, the Amazon Selling Partner API Data Protection Policy and Acceptable Use Policy, and all applicable marketplace programme policies.
2.2 You must not use our platform, or any feature of it, to do anything that would breach those agreements, or to conceal, obscure or make such a breach harder to detect.
2.3 Where a marketplace's terms conflict with something our platform permits, the marketplace's terms govern. Our platform providing a capability is not permission to use it in a way your marketplace agreement forbids.
2.4 You are responsible for the acts and omissions of anyone you give access to your account, including staff, agencies and contractors.
3. Prohibited activities
You must not use our platform, in whole or in part, to conduct, assist, enable or conceal any of the following.
3.1 Review and ranking manipulation
- Brushing — sending unsolicited, empty or misdescribed shipments to real or fabricated recipients in order to generate transaction records, verified-purchase reviews, or ranking signals.
- Creating, purchasing, exchanging, soliciting or incentivising fake, paid or otherwise inauthentic reviews, ratings or seller feedback.
- Offering a benefit — payment, refund, discount, gift or product — in exchange for a review, or conditional on a review's content or rating.
- Attempting to remove, suppress or retaliate against a genuine negative review.
- Placing or arranging orders that are not genuine consumer purchases, including self-purchase or purchase through associates, in order to influence ranking, velocity or eligibility.
- Manipulating search ranking, buy-box eligibility or promotional placement by any deceptive means.
What our platform does provide. Where a marketplace offers an official, sanctioned mechanism to request a review, our platform uses that mechanism only — the marketplace's own API, with the marketplace composing and sending the message, at the frequency and within the timing window the marketplace permits. Requests are sent one order at a time; the content cannot be customised, recipients cannot be selected by expected sentiment, and every request is logged against the user who sent it. We provide no capability to solicit, incentivise or influence the content of a review.
3.2 Intellectual property infringement
- Listing, offering or distributing counterfeit, replica or unauthorised goods.
- Using trademarks, brand names, logos, copyrighted images, product photography, listing copy or patented designs that you do not own or have no right to use.
- Copying another seller's listing content, images or brand assets.
- Misusing a marketplace's brand-protection or intellectual-property programmes, including filing bad-faith infringement complaints against competitors.
- Using our content-generation features to produce material that infringes a third party's intellectual property, or to imitate another brand's protected assets.
3.3 Deceptive and abusive practice
- Misrepresenting the origin, condition, authenticity, quantity or specification of goods.
- Operating multiple seller accounts in breach of a marketplace's policy, or using our platform to coordinate accounts in a way intended to evade a restriction or suspension.
- Circumventing marketplace fees, transaction flows, or buyer-seller messaging rules.
- Diverting buyers off-marketplace in breach of marketplace policy.
- Impersonating another business, brand or individual.
3.4 Data misuse
- Using buyer or consumer personal data for any purpose other than fulfilling the order it relates to, or as the applicable marketplace and data protection law permit. Amazon buyer personal information may be used only to ship the order it relates to, or for legally required tax reporting.
- Marketing to buyers using marketplace-derived data where that is prohibited.
- Uploading personal data to our platform that you have no lawful basis to process.
- Attempting to access, derive or infer another customer's data.
- Extracting data from our platform to build or supply a competing dataset or service.
3.5 Platform and technical abuse
- Attempting to circumvent authentication, authorisation, tenant isolation, rate limits or usage metering.
- Probing, scanning or testing our systems without our prior written authorisation.
- Sharing account credentials, or providing access to anyone not authorised by you.
- Introducing malicious code, or using the platform to distribute it.
- Automated access that materially degrades service for others.
4. Intellectual property protection measures
4.1 Your content. You retain ownership of content and data you provide. You grant us only the limited licence necessary to operate the service for you.
4.2 Warranty of rights. You warrant that you hold all rights necessary for the content you upload, generate or publish through our platform, including product images, listing copy, brand assets and trademarks.
4.3 Generated content. Where our platform generates draft text or images, you are responsible for reviewing it before publication and for ensuring it does not infringe any third party's rights. Generated drafts are suggestions, not verified clearances.
4.4 Notice and action. We operate a notice procedure for intellectual property complaints. Rights holders may contact ceo@evanik.com with details of the claimed right and the material concerned. We act on well-founded notices, which may include removing material, disabling a feature, or suspending an account.
4.5 Repeat infringement. Accounts subject to repeated substantiated infringement complaints are terminated.
4.6 Our materials. Our software, interfaces, documentation and brand assets remain ours. You may not copy, reverse engineer, or create derivative works from them except as law permits.
5. Monitoring, enforcement and reporting
5.1 Signals we act on. We do not surveil customer activity, but we act on indicators available to us — including marketplace-published account health and policy violation data ingested through official APIs, platform abuse signals, and reports from third parties and rights holders.
5.2 Investigation. Suspected breaches are investigated under a defined procedure with a tracked case record, a named owner, and preserved evidence.
5.3 Action we may take. Depending on severity: request an explanation; disable a specific feature; suspend access immediately; or terminate the account. Suspected serious breach does not require confirmation before suspension — where we cannot satisfy ourselves that no violation has occurred, we suspend.
5.4 Reporting to marketplaces. Where we suspect or confirm that a customer is violating their agreement with a marketplace, we report it to that marketplace. For Amazon, we notify Amazon atspapi-abuse@amazon.com. Reporting is not conditional on the outcome of our own investigation — we report suspicion, and supplement as facts develop.
5.5 No confidentiality for violations. You acknowledge that information concerning a suspected agreement violation may be disclosed to the affected marketplace and, where required, to authorities. This is not treated as confidential information of yours.
5.6 Evidence preservation. On suspension for a suspected violation, relevant records and audit evidence are preserved rather than deleted, so that the marketplace and any competent authority can investigate.
5.7 No waiver. Our not having acted on a breach previously does not waive our right to act.
6. Your obligations to us
You must notify us promptly if you become aware of: any breach of this policy on your account; any compromise of your account credentials; any marketplace enforcement action against you that relates to how you use our platform; or any intellectual property complaint concerning content you have published through our platform.
7. Changes
We may update this policy. Material changes are notified before taking effect. Continued use after the effective date constitutes acceptance.
